1. Acceptance of these terms
These Terms of Use ("Terms") are a legal agreement between you and Golph LLC ("Golph," "we," "us," or "our") governing your use of the Golph mobile application and related services (the "App"). By downloading, accessing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
2. License
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple-branded devices that you own or control, for your personal, non-commercial use, in accordance with Apple's App Store Terms of Service. This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at once.
3. The App is a golf aid, not a guarantee
Golph provides GPS-based distances, course imagery, aim guidance, and scoring features. Distances and locations are estimates derived from GPS and third-party map data and may be inaccurate due to satellite imagery, signal conditions, course changes, or device limitations. The App is provided as a convenience and aid only — you are responsible for your own play and decisions, and you should not rely solely on the App. Always follow course rules and use your own judgment.
4. Accounts
Accounts are optional; you may play as a guest. If you create an account, you are responsible for keeping your credentials secure and for activity that occurs under your account. Provide accurate information and notify us of any unauthorized use. You may request deletion of your account at any time by contacting us.
5. Acceptable use
You agree not to:
- Copy, modify, distribute, sell, lease, or create derivative works of the App;
- Reverse engineer, decompile, or attempt to extract the source code of the App, except to the extent that law permits;
- Use the App for any unlawful purpose, or to interfere with or disrupt the App or its servers;
- Attempt to gain unauthorized access to any part of the App or related systems.
6. Intellectual property
The App, including its design, content, logos, and software, is owned by Golph and its licensors and is protected by intellectual-property laws. Except for the license granted above, we reserve all rights. The data and history you create remain yours; you grant us the rights necessary to operate the App and provide its features to you.
7. Third-party services
The App uses third-party services and data, including Apple Maps and Apple platform services. Your use of those is also governed by the applicable third party's terms. We are not responsible for third-party services and do not endorse their content.
8. Apple-specific terms
You acknowledge that these Terms are between you and Golph only, and not with Apple, and that Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price (if any); to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App. Apple is not responsible for addressing any claims by you or any third party relating to the App, including product-liability, regulatory, or intellectual-property claims. You represent that you are not located in a country subject to a U.S. Government embargo or designated as "terrorist supporting," and are not on any U.S. Government restricted-parties list. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT DISTANCES OR DATA WILL BE ACCURATE.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, GOLPH AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE APP. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID FOR THE APP IN THE PRIOR TWELVE MONTHS OR USD $25.
11. Indemnification
You agree to indemnify and hold harmless Golph and its operators from any claims, damages, or expenses (including reasonable legal fees) arising out of your misuse of the App or violation of these Terms.
12. Governing law
These Terms are governed by the laws of the State of Florida and the United States, without regard to conflict-of-laws principles. You agree to the exclusive jurisdiction of the state and federal courts located in Florida for any dispute not subject to arbitration or small-claims court, to the extent permitted by law.
13. Changes to these terms
We may update these Terms from time to time. When we do, we'll revise the "Last updated" date above. Your continued use of the App after changes take effect means you accept the updated Terms.
